Image Licensing Terms

All digital images sold or delivered by Brisk Haven Photography, owned and operated by Christopher Smith, are protected by United States and international copyright laws. Purchasing a digital file grants you a license to use the image, not ownership of the copyright. Christopher Smith retains all intellectual property rights to all photographs unless a written transfer agreement is executed.

These Image Licensing Terms explain the rights granted to you when purchasing digital downloads.

1. Personal-Use License

A Personal-Use License is included with standard digital file purchases unless a Commercial License is explicitly purchased.

Under a Personal-Use License, you MAY:

  • Use the image as a desktop or phone wallpaper

  • Print the image for personal display (home, office, gifts)

  • Share the image on your personal social media accounts with photographer credit (“Photo by Brisk Haven Photography”)

  • Store the file for your private use

Under a Personal-Use License, you MAY NOT:

  • Use the image for any business or organizational purpose

  • Use the image for advertising, marketing, or promotional materials

  • Use the image on any website, blog, portfolio, or social media account connected to a business

  • Use the image for editorial, commercial, or fundraising purposes

  • Resell, sublicense, or give the file to anyone else

  • Upload the image to stock photography sites, AI training datasets, or similar platforms

  • Remove or alter watermarks, metadata, or copyright notices

  • Create derivative works without permission

  • Use the image on physical merchandise of any kind

If you need rights beyond personal use, a Commercial License must be purchased.

2. Commercial-Use License

A Commercial-Use License must be purchased separately and grants broader usage rights for businesses, organizations, publications, and creators. Commercial license fees vary based on intended use.

Under a Commercial-Use License, you MAY:

  • Use the image on business websites, blogs, and online stores

  • Use the image on business social media accounts

  • Use the image in marketing, promotional, or advertising materials

  • Use the image for editorial purposes (articles, magazines, publications)

  • Use the image for branding materials (brochures, signage, presentations)

  • Use the image on physical merchandise (T-shirts, mugs, calendars, postcards, book covers, packaging, etc.)

  • Print and display the image in commercial environments (offices, stores, hospitality settings)

Under a Commercial-Use License, you MAY NOT:

  • Resell or sublicense the image file itself

  • Claim the image as your own work

  • Use the image in a way that is defamatory, pornographic, hateful, political, or unlawful

  • Upload the image to stock libraries, shared image banks, or AI datasets

  • Transfer the license to another individual or business

  • Use the image in NFTs, blockchain products, or digital collectibles unless explicitly stated in writing

Any use beyond the scope of the purchased commercial license requires written approval and may incur additional licensing fees.

3. No Copyright Transfer

Purchasing any license does not transfer copyright.
All images remain the sole intellectual property of Christopher Smith / Brisk Haven Photography.

4. License Enforcement

Unauthorized use, reproduction, or distribution of images is considered copyright infringement and may lead to:

  • License revocation

  • Additional licensing fees

  • DMCA takedown notices

  • Legal action and monetary damages

We actively monitor online and commercial use of Brisk Haven Photography’s images.

5. Refunds

Digital downloads are considered final sale due to the nature of digital goods.
No refunds will be issued once the file has been delivered.
